Yet another Supreme Court term is newly underway, and it's already shaping up to be just as dramatic as the last. One of the big themes so far has to do with the court's use of "shadow dockets," from former President Donald Trump to South Carolina Sen. Lindsey Graham to Arizona state Sen. Kelli Ward. The fact that these are all conservative politicians may not be a coincidence. "Indeed, one of the most troubling features of these rulings, the majority of which come with no analysis, is their rather predictable tendency to favor Republicans and/or hurt Democrats," writes Steve Vladeck.
But that's not the only problem with the shadow docket trend. "Perhaps worst of all, these shadow docket 'emergency' procedures allow unlawful policies to continue, sometimes for years," writes Vladeck.
