Former President Donald Trump is scheduled to give testimony today under oath as part of a lawsuit filed by a woman who says he raped her in the mid-1990s. And Jessica Levinson says this is one case where clamming up won't be as much help. He can plead the Fifth, Levinson writes, "but a jury in a civil case is often allowed to draw a negative inference from that decision." E. Jean Carroll sued Trump for defamation when he responded to her rape allegation by calling her a liar. Trump argues that because he was president in 2019, the federal government is the rightful defendant. But Levinson is adamant that "taxpayers should not be footing the bill for such a defense."
